Pellicone v. New Castle County
Defendant-appellant Donald Pellicone appealed a Superior Court judgment confirming that New Castle County had certain easements on Pellicone's property. The County sought the
easements' validation to carry out a flood control project targeting Little Mill Creek in New Castle County. The issues on appeal to the Supreme Court were: (1) whether the Flood Control Project legally constituted a County project; (2) whether the County's condemnation of Pellicone's property fell within the County's statutory eminent domain authority; (3) whether the County's action was a taking of Pellicone's property for a public use as defined by law; and (4) whether the procedures set forth in Chapter 12, Article 7 adhered to. Answering all questions raised on appeal as "yes," the Supreme Court affirmed the Superior Court's judgment.

SourceGas Distrib., LLC v. City of Hastings
SourceGas Distribution, LLC owned property located in an area that had been annexed by the City of Hastings. The City, on behalf of the board of public works, filed a petition in the county court under the general condemnation procedures found at Neb. Rev. Stat. 76-101 through 76-726, seeking to initiate condemnation proceedings against the property owned by SourceGas. In an effort to enjoin the county court proceedings, SourceGas Distribution filed a complaint in the district court for temporary and permanent injunction, primarily alleging that the City must utilize Nebraska’s Municipal Gas System Condemnation Act (the Act) rather than the procedures in chapter 76. The district court overruled the motion for temporary injunction and dismissed the complaint, concluding that Neb. Rev. Stat. 19-4626(2) exempted the City from being required to proceed under the Act and that the City could utilize chapter 76’s general condemnation procedures. The Supreme Court affirmed, holding that the district court correctly concluded that, pursuant to the exception set forth in section 19-4626(2), the Act does not apply in this case and, instead, the general condemnation procedures of chapter 76 apply. Amherst Realty, LLC v. The Woods at Killington Owners Association, Inc.
Appellants Amherst Realty, LLC, Richard Madowitz, and the personal representatives of the Estate of Douglas Kohl appealed a superior court's grant of summary judgment to The Woods at Killington Owners’ Association on Amherst Realty’s claim of breach of contract based on the Association’s alleged interference with its development rights at The Woods at Killington. The Association cross-appealed the superior court’s decision granting summary judgment to Amherst Realty on the Association’s consumer fraud counterclaim. This controversy the center of this case concerned the consequences of the attempt and ultimate failure to build 40 units at The Woods. Rayellen Resources, Inc. v. Lyons
The New Mexico Cultural Properties Review Committee recognized approximately 400,000 acres of public land on Mount Taylor as a registered cultural property under the New Mexico Cultural Properties Act. One month after the Committee issued its final order, Rayellen Resources, Inc., and numerous other parties including the Cebolleta Land Grant (the Rayellen parties) appealed that decision. The Pueblo of Acoma, which joined the Committee in defending the listing, challenged whether the Rayellen parties who are private landowners had standing to appeal because they were explicitly excluded from the listing. In reaching the merits of the case, the district court found that the listing did not violate constitutional protections against the establishment of religion and that the Committee did not violate due process guarantees by following federal guidelines for the listing. The district court reversed the listing nevertheless on the grounds that personal notice of the permanent listing’s public comment period was not provided to all affected property owners, including mineral rights holders, in violation of due process guarantees, and that both the mountain’s sheer size and the private property exclusions made it impracticable to comply with provisions in the Cultural Properties Act relating to integrity of place, required inspections, and required maintenance. The district court also reversed the inclusion of the 19,000 acres of Cebolleta Land Grant common lands in the listing because land grant common lands are not subject to regulation as state land under the Cultural Properties Act. Acoma Pueblo petitioned for certiorari in the Court of Appeals on the three listing issues which the district court reversed, and the Rayellen parties cross-petitioned on other issues as to which they had not prevailed in the district court. The Court of Appeals granted those petitions as well as motions to intervene from Laguna Pueblo and the Committee. Without deciding any of the issues, the Court of Appeals then certified the entire case to the Supreme Court. After its review, the Supreme Court affirmed in part the Committee’s decision and held that the Mount Taylor listing was lawful under the Cultural Properties Act and that the proceedings before the Committee did not violate the constitutional guarantee of due process of law. The Court reversed the Committee’s inclusion of 19,000 acres of Cebolleta Land Grant property and held that land grant property is not state land as defined in the Cultural Properties Act.

Darling International, Inc. v Carter
This case involved a dispute over title to a 7.63 acre parcel of land located in Bacon County. The parcel was originally part of a 95-acre parcel owned by H.S. Carter that was taken by Bacon County via eminent domain proceedings commenced in 1973. As a result of the condemnation proceedings, Bacon County acquired over 2500 acres for creating a public recreation project known as Lake Alma and the Carter parcel was just one of the parcels condemned for that purpose. The proposed Lake Alma was part of a larger urban development project so that the City of Alma and Bacon County could execute a development plan that included, among other things, an industrial park, a waste water treatment plant, and improvement of the local airport, in addition to construction of Lake Alma. The other projects were completed but the Lake Alma project was abandoned and never constructed. After the project was abandoned, at the request of the city and county, the General Assembly passed an amendment to OCGA 36-9-3 that permitted counties to sell back to the original owners land that had been acquired for development, but the legislation failed to provide for repurchase of land by the heirs of the original owners. By that time, H.S. Carter was deceased and his original parcel was one of the only parcels condemned for construction that was not repurchased by the original owner. In 2010, OCGA 36-9-3 was amended again to grant the heirs of the original landowners the right to repurchase the land. Heirs of H. S. Carter sought to repurchase the original 95-acre parcel. The City of Alma executed a quit claim deed to Bacon County conveying its undivided interest in the 95 acres and, that same day, Bacon County executed a quit claim deed conveying all of its undivided interest in the property to the heirs. The heirs then filed a petition to quiet title and for ejectment against Darling and Southeastern Maintenance with respect to the 7.63 acres. Darling asserted it was entitled to summary judgment with respect to the quiet title and claim for ejection because, as a result of the county’s previous conveyance of the disputed property to the Development Authority and the subsequent chain of conveyances by which Darling ultimately obtained title, the heirs did not have title to that property. Without addressing Darling’s bona fide purchaser argument, the trial court entered judgment in favor of the heirs along with a decree that title to the property vested in them and was superior to Darling’s claim of title. Upon review of the matter, the Supreme Court concluded the trial court erred in concluding that the heirs’ title was superior to that of Darling’s as a result of Bacon County’s failure to comply with the requirements of OCGA 36-9-2 with respect to a 2003 conveyance of its interest in the property to the Bacon County Development Authority. Furthermore, the trial court erred in finding the 2003 conveyance to Southeastern Maintenance was invalid as a result of the governing authorities’ failure to formulate a new economic development plan. The trial court’s order granting summary judgment to the Carter heirs was reversed and the decree establishing title was vacated.

Kellberg v. Yuen
At issue in this case was a forty-nine acre parcel of land. After the County of Hawai’i and the County Planning Director (collectively, County Defendants) gave the subject property’s owners approval to subdivide the property, Plaintiff, an adjacent land owner, filed an action challenging the subdivision approval. The circuit court ultimately granted summary judgment on all counts for the County Defendants, concluding that no genuine issue of material fact existed in this case. The intermediate court of appeals (ICA) vacated the circuit court’s judgment and remanded for an order dismissing the case, concluding that Appellant failed to exhaust his administrative remedies, and therefore, the circuit court lacked jurisdiction to act on the complaint. The Supreme Court vacated the ICA’s judgment and remanded to the ICA for consideration of the remaining issues raised by Plaintiff in his appeal, holding that Appellant did not fail to exhaust administrative remedies.View "Kellberg v. Bd. of Supervisors of James City County v. Windmill Meadows, LLC
At issue in this case was Va. Code Ann. 15.2-2303.1:1(A), which provides that cash payment made pursuant to a cash proffer offered or accepted for residential construction on a per-dwelling unit shall be accepted by any locality only after the completion of the final inspection of the property. Here several developers and Williamsburg Landing (collectively, Respondents) made proffers to the County, which included per-dwelling cash payments, related to the rezoning of their property. The cash payments for some dwelling units made by Respondents were accepted by the County under the terms of the proffers after June 30, 2010 and prior to the completion of a final inspection of the dwelling units. The County filed a complaint for declaratory judgment, contending that section 15.2-2303.1:1(A) had no application to proffers agreed to prior to its effective date of July 1, 2010. The district court granted summary judgment to Respondents. The Supreme Court affirmed the grant of summary judgment, holding that the circuit court did not err in ruling that section 15.2-2303.1:1(A) applies to all payments of cash proffers due on or after July 1, 2010 regardless of whether the proffers were agreed to prior to that date.View "Bd. of Supervisors of James City County v. Bd. of Supervisors of Prince George County v. McQueen
Landowner initiated plans to develop his property as a cluster subdivision. Landowner received a compliance letter from the county zoning administrator indicating that Landowner’s property met the standards set forth in the applicable ordinance. After the zoning administrator issued the compliance letter, the county’s board of supervisors repealed the ordinance. Landowner filed a declaratory judgment action against the county and the board, seeking a declaration that he obtained a vested right to develop his property as a by-right cluster subdivision in accordance with the terms of the ordinance. In support of his claim, Landowner asserted that the compliance letter constituted a significant affirmative governmental act under Va. Code Ann. 15.2-2307, which was necessary to find Landowner had vested land use rights. The circuit court ruled in favor of Landowner. The Supreme Court reversed, holding (1) the zoning administrator’s issuance of the confirmation letter was not a significant affirmative governmental act; and (2) therefore, the circuit court erred in holding that Landowner acquired a vested right under section 15.2-2307 to develop his property as a cluster subdivision.

Sleeper v. Loring
Plaintiffs owned property near but not on Sebago Lake. Defendants owned shorefront property on the lake. Through their deeds, Plaintiffs acquired an easement consisting of a right-of-way over lot 40A, a strip of land situated between Defendants' lots. In 2007, the lot was conveyed to Defendants. Before the conveyance, Plaintiffs obtained a permit for the construction of a dock extending from the lot to the lake. In 2010, the Town's code enforcement officer rescinded the permit and ordered the dock to be removed. The Town's zoning board upheld the enforcement officer's decision. Plaintiffs filed suit, challenging the zoning board's decision and Defendants' fee simple title to the lot and seeking a declaratory judgment that they were entitled to maintain a dock on the lot. Ultimately, the superior court found Defendants held fee simple title to the lot and that the easement held by Plaintiffs did not grant them a right to maintain the dock. The Supreme Court vacated the judgment, holding that the deed in Defendants' chains of title unambiguously excepted the lot from a prior conveyance and that deeds in Plaintiffs' chains of title were ambiguous as to whether the dock was allowed. Sierra Club v. Castle & Cooke Homes Haw., Inc.
In April 2010, the State Senate expressly rejected Duane Kanuha's nomination for a second term as a commissioner on the State Land Use Commission (LUC). Following the Senate's rejection, Kanuha continued to serve on the board and to participate in the LUC's consideration of a development project involving the reclassification of agricultural land for urban use. Sierra Club filed an action to disqualify Kanuha from serving on the LUC and to invalidate the actions Kanuha had taken with regard to the development project. The LUC denied the action. That same day, LUC voted to approve the development project. Without Kanuha's vote, the LUC lacked the requisite number of votes to approve the reclassification. The circuit court reversed the LUC's decision and order. The ICA reversed, determining that Kanuha continued to serve as a valid holdover member of the LUC after the Senate's rejection of his nomination for a second term. The Supreme Court reversed, holding (1) Kanuha was not a valid holdover when he voted on the reclassification; (2) Kanuha did not qualify as a de facto member of the LUC; and (3) therefore, Kanuha's actions taken with respect to the reclassification petition were invalid.
